Terms of Service

TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the Staged AI mobile application and any related websites, services, and content (collectively, the “Service”) provided by SwipeFeed LLC (“SwipeFeed,” “we,” “us,” or “our”). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

-- 1. Eligibility --

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

-- 2. License to Use the Service --

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Staged AI app on a device that you own or control and to access and use the Service solely for your personal or internal business purposes.

You may not:

  • copy, modify, or create derivative works of the Service;
  • reverse engineer, decompile, or attempt to extract the source code of the Service except where permitted by law;
  • rent, lease, sell, sublicense, or otherwise transfer your rights in the Service;
  • circumvent or attempt to circumvent any security or access controls of the Service.

-- 3. User Accounts and Subscriptions --

Access to certain features may require you to purchase a subscription through the Apple App Store or other authorized marketplaces. Billing, renewal, cancellation, and refunds are handled by the platform through which you purchased the subscription and are subject to its terms and policies.

You are responsible for maintaining the security of your device and any login credentials associated with your use of the Service. You are responsible for all activities that occur under your account or on your device.

-- 4. User Content --

“User Content” means any photos, images, text, or other materials you submit, upload, or otherwise make available through the Service.

You retain all rights in and to your User Content, subject to the rights granted below. By submitting User Content to the Service, you grant SwipeFeed a worldwide, non-exclusive, royalty-free license to host, process, and display your User Content solely for the purpose of operating, providing, and improving the Service (including generating AI-powered designs and staging results for you).

You represent and warrant that:

  • you own or have all necessary rights to your User Content;
  • your User Content does not infringe, misappropriate, or violate any third-party rights, including privacy, publicity, or intellectual property rights;
  • your User Content does not contain any illegal, harmful, or offensive material.

We may, but are not obligated to, remove or disable access to any User Content that we believe violates these Terms or applicable law.

-- 5. AI-Generated Content and Professional Use --

The Service uses artificial intelligence models to generate images, design suggestions, and other outputs (“AI Output”). AI Output is generated automatically based on your inputs and may be imperfect, inaccurate, or unrealistic. You are solely responsible for reviewing and evaluating any AI Output before relying on it.

AI Output is provided for informational and illustrative purposes only and does not constitute architectural, engineering, or interior design advice. You should not rely on AI Output as a substitute for professional services or safety assessments.

To the extent permitted by law, SwipeFeed disclaims any ownership in your AI Output and grants you permission to use AI Output for personal or commercial purposes, subject to these Terms and any restrictions imposed by third-party model providers or distribution platforms you use (for example, real estate listing rules).

You are solely responsible for ensuring that your use of AI Output complies with all applicable laws, regulations, and third-party rights.

-- 6. Acceptable Use --

You agree that you will not use the Service to:

  • upload, generate, or share content that is unlawful, defamatory, harassing, hateful, obscene, or otherwise objectionable;
  • violate any applicable law, regulation, or third-party right;
  • attempt to exploit or harm minors;
  • upload or process materials containing personal data of others without their consent where required by law;
  • interfere with or disrupt the Service or servers or networks connected to the Service;
  • use any automated means to access, scrape, or extract data from the Service without our prior written permission.

We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms.

-- 7. Third-Party Services and Links --

The Service may integrate with or provide links to third-party services, such as payment processors, analytics providers, or AI model providers. We do not control and are not responsible for the content, policies, or practices of any third-party services. Your use of such services is governed by their own terms and privacy policies.

-- 8. Intellectual Property --

The Service, including all software, interfaces, graphics, logos, and other content (excluding your User Content), is owned by SwipeFeed or its licensors and is protected by copyright, trademark, and other laws. Except for the limited license expressly granted in Section 2, no rights are transferred to you.

“Staging AI,” the Staged AI logo, and any related names or logos are trademarks of SwipeFeed LLC. You may not use our trademarks without our prior written permission.

THE SERVICE AND ALL CONTENT (INCLUDING AI OUTPUT) ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SWIPEFEED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY AI OUTPUT WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

-- 10. Limitation of Liability --

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SWIPEFEED LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL), ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR ACCESS TO THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

-- 11. Indemnification --

You agree to indemnify, defend, and hold harmless SwipeFeed LLC and its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:
(a) your access to or use of the Service or AI Output;
(b) your User Content; or
(c) your violation of these Terms or any applicable law or third-party right.

-- 12. Termination --

You may stop using the Service at any time by uninstalling the app. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, create risk or possible legal exposure for us, or if we cease providing the Service.

Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination (including Sections 4–12) will remain in effect.

-- 13. Changes to the Service and to These Terms --

We may update or modify the Service from time to time, including by adding or removing features. We may also revise these Terms occasionally. When we do, we will update the “Last updated” date above. If we make material changes, we may provide additional notice within the app or by other means.

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.

-- 14. Governing Law and Dispute Resolution --

These Terms and your use of the Service are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Boston, Massachusetts, and you and SwipeFeed consent to the personal jurisdiction of such courts.

If you are a consumer located in a jurisdiction that provides you with mandatory local law protections, this section shall not deprive you of the protection of such laws.
